TERMS AND CONDITIONS OF THE HYTI ONLINE STORE

These Terms and Conditions apply to the purchase of goods from the online store HYTI (hereinafter the Online Store).

The owner of the Online Store is Namari OÜ (registry code 12691392), located at Kopli 38/1-5, Tallinn 10412, Estonia. The official website of the Online Store is www.hytidesign.com.

1. Validity of the Sales Contract, Product and Price Information

1.1. These Terms and Conditions apply to all purchases made from the Online Store.

1.2. All prices of products sold in the Online Store are displayed next to the products and are in euros (€). Delivery costs are added to the product price.

1.3. Delivery costs depend on the buyer’s location and the chosen delivery method. The applicable delivery fee is displayed during checkout.

1.4. Information about each product is provided directly next to the product in the Online Store. As HYTI products are handmade glass objects, minor variations in size, colour, tone, and details may occur and are not considered defects.

2. Placing an Order

2.1. To order goods, the desired products must be added to the shopping cart. To complete the order, the required data fields must be filled in and a suitable delivery method selected.

2.2. The total amount payable is then displayed and can be paid securely using the following payment methods:

Bank payments in Estonia, Finland, Latvia, and Lithuania
Visa and Mastercard card payments
Apple Pay and Google Pay
Other payment solutions displayed in the Online Store

2.3. Payments are mediated by Maksekeskus AS. Payment takes place outside the Online Store in a secure environment. The seller has no access to the buyer’s bank or credit card details.

2.4. The sales contract enters into force once the payable amount has been received in the Online Store’s bank account.

2.5. The owner of the Online Store is the controller of personal data and transmits the personal data necessary for payment processing to the authorised processor Maksekeskus AS.

2.6. If the ordered goods cannot be delivered (e.g. the product is out of stock or production is delayed), the buyer will be informed as soon as possible and the paid amount will be refunded without delay, but no later than within 14 days of sending the notice.

3. Delivery

3.1. Goods are delivered to the following countries: Estonia and other European Union countries (to be specified if necessary).

3.2. The buyer may choose between the delivery options offered in the Online Store. Delivery services used include Omniva, Itella SmartPOST, DPD, and DHL, as well as the option to collect the order from the studio.

3.3. Delivery costs are borne by the buyer and the relevant price information is displayed when selecting the delivery method.

3.4. Domestic shipments within Estonia usually arrive at the destination specified by the buyer within 3–7 business days from the entry into force of the sales contract. Deliveries outside Estonia generally take 7–21 calendar days.

3.5. For standard products, goods usually arrive within the timeframes indicated in these Terms and Conditions. In exceptional cases (e.g. increased order volume or logistical delays), the Online Store has the right to deliver the goods within up to 45 calendar days.

3.6. Delivery time for custom-made products depends on the product, production volume, and materials used, and is generally 2–6 weeks, unless stated otherwise on the product page. The estimated delivery time for a custom order is displayed during checkout or agreed separately after the order has been placed.

3.7. The delivery time for custom-made products may be extended due to the nature of the handmade production process, material-specific characteristics, or production workload. The Online Store will inform the buyer without delay if it becomes clear that the agreed delivery time cannot be met.

4. Right of Withdrawal

4.1. The buyer has the right to withdraw from the sales contract concluded in the Online Store within 14 days of receiving the goods.

4.2. The right of withdrawal does not apply if the buyer is a legal entity.

4.3. Considering that HYTI products are handmade and partly made to order, the right of withdrawal does not apply to products that are custom-made according to the buyer’s personal specifications (pursuant to § 53(4) of the Estonian Law of Obligations Act).

4.4. To exercise the right of withdrawal, the goods may not be used in any way other than what is necessary to ascertain the nature, characteristics, and functioning of the goods, as would be allowed in a physical store.

4.5. If the goods have been used beyond what is permitted or show signs of wear, the Online Store has the right to reduce the refundable amount in accordance with the decrease in the value of the goods.

4.6. To return the goods, a withdrawal notice must be submitted and sent to hello@hytidesign.com no later than 14 days after receipt of the goods.

4.7. The cost of returning the goods is borne by the buyer, unless the reason for return is that the product does not correspond to the order (e.g. incorrect or defective product).

4.8. The Online Store will refund all payments received from the buyer without delay, but no later than within 14 days of receiving the withdrawal notice.

5. Right to Submit a Complaint

5.1. The Online Store is liable for non-conformity of the goods with the contract that becomes apparent within two years from the delivery of the goods to the buyer.

5.2. In the event of a defect, the buyer must notify the Online Store no later than within two months by sending an email to hello@hytidesign.com or by calling +372 56481121.

5.3. If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If repair or replacement is not possible, the Online Store will refund all payments related to the sales contract.

5.4. The Online Store will respond to the consumer’s complaint in writing or in a form that can be reproduced in writing within 15 days.

6. Processing of Personal Data and Direct Marketing

6.1. The Online Store uses the personal data entered by the buyer solely for processing the order, delivering the goods, and fulfilling legal obligations.

6.2. Personal data is disclosed to third parties (e.g. payment service providers and logistics partners) only to the extent necessary for providing the service.

6.3. Newsletters and promotional offers are sent only if the buyer has given explicit consent.

6.4. The buyer has the right to unsubscribe from newsletters at any time.

7. Dispute Resolution

7.1. Complaints should be sent to hello@hytidesign.com or submitted by phone at +372 56481121.

7.2. If disputes cannot be resolved by mutual agreement, the buyer has the right to turn to the Consumer Disputes Committee of Estonia or to the European Union’s online dispute resolution platform.

These Terms and Conditions have been drafted in accordance with the legislation of the Republic of Estonia and take into account the specific nature of HYTI as a handmade design brand.
